Terms of Use

These Terms govern your use of the CheckinGuest application (“the App”) during your stay. By completing check-in through the App you accept them.

Your accommodation is the subject of a separate agreement between you and the accommodation provider. These Terms do not affect that agreement or any right arising from it.

1. Parties

1.1 The App is operated by Prague Retreat Management s.r.o., IČO 22473874, Revoluční 1082/8, Nové Město, 110 00 Praha 1, Czech Republic (“the Operator”, “we”).

1.2 Your accommodation provider is Prague Retreat Management s.r.o., IČO 22473874, Revoluční 1082/8, Nové Město, 110 00 Praha 1, Czech Republic (“the Provider”).

1.3 The Provider is your counterparty for accommodation, for any sum paid through the App, and for the conduct of your stay. The Operator supplies the software only.

1.4 Enquiries concerning your stay should be directed to the Provider. Enquiries concerning the App may be directed to info@pragueretreat.com.

2. Registration and accuracy of information

2.1 The App collects the particulars the Provider is required to record and report to the Police of the Czech Republic under Act No. 326/1999 Coll. on the Residence of Foreign Nationals. The processing of those particulars is described in the Privacy Notice.

2.2 You warrant that the information you provide is true, accurate and complete. Submission of false particulars in a guest registration is an offence under Czech law and remains your sole responsibility.

2.3 Where you elect to photograph a travel document, the App extracts the particulars from the image. You are shown every extracted field and must confirm it before submission. You remain responsible for the accuracy of the confirmed data.

3. Access codes

3.1 Where the accommodation is equipped with an electronic lock, the App issues an access code valid for the duration of your stay. The code expires at the end of the stay.

3.2 The access code is personal to you. You must not disclose it to any third party, and you are responsible for any consequence arising from its disclosure.

3.3 Electronic locks depend on battery power, network availability and the functioning of your own device. The Operator does not warrant uninterrupted availability of the access function.

3.4 Your entitlement to access the accommodation arises from your agreement with the Provider and does not depend on the App. In the event of failure, contact the Provider, who will provide access by alternative means. Contact details are available in the App and on your booking confirmation.

3.5 You must not attempt to open a lock by force or by any means other than those provided. Damage so caused is chargeable.

4. Payments

4.1 The App permits payment of certain charges. All such payments are made to the Provider. The Operator is not party to the transaction and holds no funds.

4.2 Accommodation tax is a charge imposed by the City of Prague. It is calculated according to the applicable municipal rate, the number of guests and the number of nights, and is collected by the Provider on the municipality’s behalf.

4.3 Additional services and events are supplied by the Provider. Prices are displayed before payment is authorised.

4.4 Card payments are processed by Stripe Payments Europe Ltd. Card details are submitted directly to Stripe and are not received or retained by the Operator or the Provider.

4.5 Refunds, cancellations and any dispute concerning a charge are matters for the Provider. Where an event is sold for a specified date, the applicable cancellation terms are shown at the point of purchase.

4.6 Nothing in this clause affects your statutory rights as a consumer.

5. Messaging and support

5.1 The App provides messaging with the Provider and an in-app support function.

5.2 You must not transmit content which is unlawful, abusive, harassing, or which infringes the rights of another person. Content in breach of this clause may be removed and access to the messaging function may be withdrawn.

5.3 Responses in the support function are generated with the assistance of an automated system and may be inaccurate or incomplete. They do not constitute advice. Matters of importance should be raised with the Provider directly.

5.4 You are advised not to transmit sensitive personal information through either function.

6. House rules

6.1 The Provider’s house rules apply throughout your stay. They are presented during check-in and remain available in the App.

6.2 Compliance with the house rules is a matter between you and the Provider.

7. Availability and liability

7.1 The Operator provides the App with reasonable skill and care. The Operator does not warrant that the App will be available without interruption, free from error, or compatible with every device.

7.2 The Operator is not liable for:

• (a) the accommodation, the premises, or any act or omission of the Provider;
• (b) any decision of the Provider, including a decision concerning a refund;
• (c) consequences arising from disclosure of an access code by you;
• (d) failure or unavailability of your own device, battery or network connection.

7.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded.

7.4 Nothing in these Terms excludes or limits any right you have under mandatory consumer protection law.

8. Personal data

Personal data processed through the App is dealt with in the Privacy Notice, which sets out the purposes of processing, the recipients of the data, the retention periods and your rights as a data subject.

9. Amendment

9.1 The Operator may amend these Terms. The version in force at the time you complete check-in governs your stay.

9.2 The date of the current version appears at the head of this document.

10. Governing law and jurisdiction

10.1 These Terms are governed by the law of the Czech Republic.

10.2 If you are a consumer, you retain the protection afforded by the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of that country.
